Terms of Service

Welcome to Neurobuff ("we", "us", "our"). These Terms of Service ("Terms") govern your access to and use of the Neurobuff websites, games, cognitive-training tools, Academy content, community, accounts, billing features, and related services (collectively, the "Service").

By creating an account, using the Service, posting in the community, or buying a paid plan, you agree to these Terms and to any policies that are linked from them, including our Privacy Policy, Disclaimer, Community Guidelines, and Subscription, Cancellation and Refund Information.

If you do not agree, you must not use Neurobuff.

Neurobuff provides:

• Cognitive-training games and exercises
• Performance metrics, analytics, progress tracking, and personal bests
• Gamified features including XP, levels, badges, gems, and streaks
• Educational Academy content, tools, and a skill-development journey
• Community features such as public forum posts and replies

Neurobuff does not provide:

• Medical, psychiatric, psychological, therapeutic, legal, or financial advice
• Diagnosis, treatment, prevention, or cure of any condition
• Emergency support or crisis services
• Guaranteed cognitive improvement, IQ increase, memory enhancement, health outcomes, or real-world performance outcomes

Neurobuff is intended as a cognitive-training, education, and entertainment platform. It is not intended, marketed, or validated for medical diagnosis, prevention, monitoring, prediction, treatment, or clinical decision-making, and it is not a substitute for professional advice. If you have concerns about your health, cognitive function, or symptoms, speak to a qualified professional. If you experience dizziness, discomfort, eye strain, blackouts, or seizure symptoms while using the Service, stop immediately and seek medical advice.

To use Neurobuff, you must:

• Be at least 16 years old
• Have permission from a parent or guardian where required by law if you are under 18
• Be able to enter into a binding agreement, or have permission from someone who can do so for you
• Not be barred from using online services under applicable law
• Provide accurate account and billing information

Accounts are personal. You must not create an account for another person unless you are their parent or legal guardian, local law permits it, and you complete the process transparently for them. We may suspend or delete accounts if we reasonably believe the user is not eligible.

When you create or use an account, you agree to:

• Use a valid email address that you control
• Provide accurate and current information
• Keep your login credentials confidential
• Not share, sell, transfer, or resell your account or paid access
• Notify us promptly if you suspect unauthorised access or misuse

You are responsible for activity on your account unless the activity happened because of our breach of these Terms or applicable law.

You agree not to:

• Use bots, scripts, automation, exploits, or unauthorised tools to gain XP, gems, scores, access, or unfair progression
• Manipulate game data, scores, analytics, billing records, subscriptions, or account state
• Attempt to hack, probe, scan, reverse engineer, bypass access controls, or disrupt the Service except where allowed by law
• Interfere with, overload, scrape, crawl, or place unreasonable load on our infrastructure or third-party providers
• Upload, submit, transmit, or link to malware, harmful code, spam, phishing, scams, or fraudulent content
• Impersonate another person or organisation, misrepresent your identity, or create accounts to evade enforcement
• Share another person's private information without permission
• Infringe intellectual property, privacy, publicity, contractual, or other legal rights
• Use the Service for illegal, harmful, abusive, threatening, harassing, hateful, sexually exploitative, or discriminatory activity
• Abuse payments, refunds, promotions, chargebacks, trials, or support processes
• Use the Service in a way that could expose us, our users, or our providers to legal, security, operational, or reputational risk

We may remove content, restrict features, suspend accounts, terminate accounts, reverse rewards or entitlements, and report unlawful conduct where we reasonably believe these rules have been broken.

Neurobuff may offer free features and paid plans. The features, prices, currencies, billing periods, taxes, and renewal terms shown at checkout form part of your purchase.

• The monthly plan is an auto-renewing subscription and renews each month until cancelled.
• The annual plan is an auto-renewing subscription and renews each year until cancelled.
• Prices may be shown in multiple currencies. Applicable taxes, if any, are shown at checkout.
• Payments are processed by Stripe. Stripe may apply its own terms, privacy notices, authentication checks, and payment processing rules.
• You authorise us and our payment processor to charge your selected payment method for purchases, renewals, taxes, and any other amounts shown at checkout.
• If checkout offers a seven-day introductory trial, your selected monthly or annual plan starts charging automatically after seven days unless you cancel before the trial ends.
• Introductory trials are limited to one per customer and payment method. We may decline or cancel a trial without charge when our systems detect previous use or cannot verify eligibility; you may then choose a normal paid subscription.

Cancellation: You may cancel in your account settings or by contacting support. If you cancel at the end of the current billing period, you keep paid access until that period expires and no automatic refund is issued for the unused period.

Immediate cancellation and refunds: If you cancel immediately, paid access ends immediately. Neurobuff currently offers a full refund if the immediate cancellation or account deletion is completed within 14 days of the relevant paid purchase or current paid period, where our payment processor can return the funds to the original payment method. After that 14-day window, refunds are not automatic and may be refused unless required by law. If a recent monthly-to-annual upgrade used unused monthly value as a proration credit, we also return that credited value. An original monthly payment still inside 14 days is refunded in full; an older monthly payment is refunded only for the unused amount carried into the annual upgrade.

This refund policy does not limit mandatory consumer rights. If the law in your country gives you stronger cancellation, refund, faulty digital content, or other consumer rights, those rights continue to apply.

The checkout-facing Subscription, Cancellation and Refund Information forms part of these Terms and explains renewal, online cancellation, the 14-day policy, and how to send a clear cancellation statement.

If your account is suspended or terminated for fraud, abuse, payment misuse, security risk, or breach of these Terms, we may revoke paid access and virtual items without refund except where a refund is required by law.

Neurobuff and its licensors own the Service and all related intellectual property, including:

• Games, game rules, mechanics, balancing, and progression systems
• XP, gems, ranks, achievements, streaks, score systems, and analytics logic
• UI/UX designs, logos, branding, artwork, animations, models, audio, and visual assets
• Software, source code, data structures, databases, documentation, and website content

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the Service for your own non-commercial use.

Unless allowed by law or by our written permission, you must not:

• Copy, modify, sell, rent, sublicense, distribute, mirror, or create derivative works from the Service
• Extract, scrape, bulk download, or reuse data, assets, content, designs, or code
• Clone or imitate the Service in a way that confuses users or infringes our rights
• Remove legal notices, branding, attribution, or technical protection measures

"User Content" means anything you submit, post, upload, or provide through the Service, including usernames, profile details, forum posts, replies, reports, feedback, and support messages. Profile avatars are selected from a curated icon list; users cannot upload personal photos.

You keep ownership of your User Content. By submitting User Content, you grant Neurobuff a worldwide, non-exclusive, royalty-free, transferable, sublicensable licence to host, store, reproduce, display, publish, moderate, format, adapt for technical display, distribute, and use that content to operate, protect, improve, and promote the Service. This general licence does not by itself authorise us to present a product review as a paid advertisement or featured testimonial. We obtain and record appropriate additional permission for that use.

You must not submit User Content that:

• Is unlawful, fraudulent, defamatory, abusive, threatening, harassing, hateful, discriminatory, sexually exploitative, or violent
• Encourages self-harm, eating disorders, dangerous acts, grooming, exploitation, or illegal activity
• Contains sexual content involving minors or any content that exploits or endangers children
• Infringes intellectual property, privacy, publicity, confidentiality, or contractual rights
• Contains another person's personal data, private information, or images without permission
• Contains spam, advertising, malware, phishing, scams, or attempts to manipulate platform systems
• Pretends to be professional medical, legal, financial, or mental health advice where it is not

Public forum posts and replies may be visible to other users and may appear in public pages, search results, or shared links. Do not include personal information in public posts unless you are comfortable making it public.

We may review, refuse, remove, edit for formatting or safety, restrict, lock, pin, anonymise, or report User Content. We may also suspend or ban accounts. We are not required to monitor everything users post, and moderation decisions do not mean we endorse User Content. You can report forum content through the in-product reporting tools or by contacting support. Our Community Guidelines describe prohibited content and our Online Safety and Complaints Policy explains illegal-content reports and moderation appeals.

Our Privacy Policy explains what personal data we collect, why we use it, our lawful bases, the categories of recipients, international transfers, retention periods, your rights, and how to contact us. Our cookie controls let you manage optional analytics and similar technologies where consent is required. Our Cookie and Browser Storage Notice provides the detailed storage inventory.

We use service providers, including authentication, database, payment, hosting, analytics, monitoring, email, and support providers, to operate Neurobuff. These providers process data for us or in connection with the Service as described in the Privacy Policy.

If you delete your account, we delete or anonymise account data in line with our Privacy Policy and product flow. Certain records may be kept where needed for tax, accounting, fraud prevention, chargeback and dispute handling, security, legal claims, or legal compliance. Public forum posts may remain visible but will be anonymised where our systems support that.

Neurobuff depends on third-party providers for functions such as payments, authentication, database hosting, infrastructure, monitoring, analytics, email delivery, content delivery, and support. These providers may include Stripe, Supabase, hosting and CDN providers, monitoring providers, and communication providers.

Third-party services may have their own terms, privacy notices, security procedures, availability limits, and payment rules. We are not responsible for third-party websites or services that we do not control, except where applicable law says otherwise.

Neurobuff is provided on an "as is" and "as available" basis. We aim to keep the Service useful and reliable, but we do not guarantee uninterrupted availability, error-free operation, or any particular uptime unless we agree that in writing.

We may:

• Temporarily suspend access for maintenance, security, abuse prevention, updates, or operational reasons
• Add, remove, rebalance, restrict, or change features, games, tools, content, prices, entitlements, or user interface elements
• Limit access to certain users, accounts, devices, locations, or regions where needed for legal, security, billing, or operational reasons
• Discontinue part or all of the Service, subject to any mandatory consumer rights that apply to paid access you already purchased

Neurobuff provides performance metrics, analytics, game results, XP, gems, ranks, achievements, streaks, and other virtual items on a best-effort basis.

You acknowledge that:

• Scores and metrics may be affected by device performance, connection quality, bugs, settings, browser behaviour, or user input
• Analytics may contain errors, delays, missing data, or estimates
• XP, gems, ranks, achievements, streaks, and virtual items have no cash value and do not create property rights
• We may adjust, correct, reset, remove, or rebalance data and virtual items to protect integrity, fix bugs, or improve the Service

You are responsible for deciding whether the Service is suitable for you. Use common sense and take breaks. Stop using Neurobuff if you feel unwell, dizzy, distressed, or uncomfortable.

To the maximum extent permitted by law, we do not guarantee that:

• The Service will improve cognition, focus, memory, reasoning, wellbeing, health, or real-world performance
• Scores, analytics, recommendations, Academy content, or progress reports are complete, accurate, or suitable for a particular purpose
• The Service will be uninterrupted, secure, compatible with every device, or free from errors, bugs, or harmful components
• User Content will be accurate, lawful, appropriate, or safe

Nothing in the Service should be treated as professional advice. You assume responsibility for how you use the Service and any decisions you make based on it. Our Health and Cognitive Content Standards explain our intended purpose and evidence approach.

To the maximum extent permitted by law:

• We are not liable for indirect, incidental, special, punitive, exemplary, or consequential losses
• We are not liable for loss of profits, revenue, goodwill, data, XP, scores, progress, virtual items, business opportunity, or anticipated savings
• We are not liable for issues caused by third-party services, user devices, internet connections, unauthorised account use, or User Content that we do not control
• Our total liability for claims relating to the Service is limited to the amount you paid Neurobuff in the 12 months before the claim arose, or GBP 100 if you paid nothing in that period

Nothing in these Terms excludes or limits liability for fraud, fraudulent misrepresentation, death or personal injury caused by negligence, statutory consumer rights, or any other liability that cannot legally be excluded or limited.

We may suspend, restrict, or terminate your account or access if:

• You violate these Terms, our policies, or applicable law
• You engage in abusive, fraudulent, harmful, or illegal behaviour
• You manipulate gameplay, progression, entitlements, billing, payments, refunds, or security systems
• Your use creates legal, security, operational, payment, or reputational risk for Neurobuff, users, or providers
• We are required or reasonably requested to do so by law, a regulator, a court, a payment processor, or a platform provider

You may delete your account through the product where that feature is available. Account deletion is intended to be permanent and may remove your profile, settings, training history, and progress. Paid access may end immediately if you delete your account.

We may retain records where needed for tax, accounting, audit, fraud prevention, chargeback and dispute handling, security, legal claims, or legal compliance. Public forum posts and replies may be retained but anonymised so that community discussions remain understandable. We may also retain aggregated or anonymised information that no longer identifies you.

We may update these Terms from time to time. The "Last updated" date shows when the latest version was posted.

If we make material changes, we will take reasonable steps to notify you, such as by email, in-product notice, or a prominent website notice. Material changes take effect on the date stated in the notice. Minor, clarifying, or legally required changes may take effect when posted.

If a material change negatively affects a paid plan during a current paid term, it will not retrospectively remove the paid access already purchased unless required for safety or law. Where required, we will give advance notice and a meaningful opportunity to cancel before a price or renewal change applies. Your mandatory consumer rights continue to apply. We may ask you to accept materially updated Terms; otherwise, continued use after clear notice and the effective date means you accept them to the extent permitted by law.

These Terms are governed by the laws of England and Wales. The courts of England and Wales will have jurisdiction, except that if you are a consumer living outside England and Wales, any mandatory rights to bring claims in your local courts or rely on mandatory local consumer protections are not limited by these Terms.
